Big Relief for Bank Account Holders: Landmark Judgment by Allahabad High Court
In a significant ruling with far-reaching implications for banking practices and customer rights, the Allahabad High Court (Lucknow Bench) has held that banks cannot arbitrarily freeze customer accounts on their own by merely invoking provisions of the Prevention of Money Laundering Act (PMLA), 2002, without any order from a competent authority.
Key Highlights of the Judgment
(Writ-C No. 1866 of 2026 - M/s S.A. Enterprises v. Reserve Bank of India & Ors.):
- Banks are not investigating agencies. They cannot unilaterally assume the role of investigators and freeze accounts based on internal suspicions or vague "suspicious transaction" claims without following due process.
- Arbitrary freezing of accounts violates the customer's legal and constitutional rights, including the right to livelihood and Article 21 of the Constitution of India.
- The Court strongly deprecated the practice of indiscriminate freezing of accounts, observing that it paralyses business operations, causes financial loss, and erodes trust in the banking system.
- The writ petition was allowed, directing the Indian Overseas Bank to de-freeze the petitioner's account.
- A compensation of ₹50,000 was imposed on the bank (payable within four weeks) for the arbitrary action.
This judgment reinforces the principle that banking operations must respect the rule of law and principles of natural justice. Banks can only freeze accounts in exceptional cases backed by:
- A specific order from a competent authority, or
- Exercise of lien under Section 171 of the Indian Contract Act, 1872 (in case of outstanding loans).
