๐ณ๏ธโ๐ SAME-SEX COUPLES CAN LEGALLY CO-OWN PROPERTY IN THE PHILIPPINES
Good news for couples building their future together ๐
In February 2026, the Supreme Court of the Philippines clarified that:
๐ Even if same-sex marriage is not yet legal in the Philippines,
๐ Same-sex partners who acquire property together can legally be recognized as co-owners.
Meaning?
If both of you contributed to buying the property โ whether:
๐ฐ One paid the downpayment
๐ฆ One paid the monthly amortization
๐จ One funded renovations
๐งพ Or both shared expenses
The property can legally belong to BOTH of you.
BUT letโs be clear:
โ This is NOT legalization of same-sex marriage
โ This does NOT automatically give inheritance rights
โ This does NOT give spousal benefits
This ruling is about PROPERTY OWNERSHIP only.
โ IMPORTANT: You must prove contribution.
Ownership will depend on actual financial or material contribution.
So keep your:
โ Receipts
โ Bank transfer records
โ Payment proofs
โ Renovation documents
The Court recognizes shared investment โ not just shared love.
In simple terms:
If you built it together, paid for it together, you can legally own it together.
๐ก Real estate is for everyone who works hard for it.

๐ DEED OF SALE, CONDITIONAL SALE, OR CONTRACT TO SELL? Know the Difference!
When buying or selling property, the kind of document you use matters. Hereโs a quick guide to help you understand which document fits your transaction best:
๐น DEED OF ABSOLUTE SALE
This is used when the sale is final and full payment has been made. Ownership is transferred to the buyer right away.
โ
Best for: Cash sales or when full payment has already been settled.
๐น DEED OF CONDITIONAL SALE
This is used when ownership is transferred immediately, but with certain conditions (e.g., balance payment in installments). If the buyer fails to meet the condition, the seller may rescind the contract.
โ
Best for: Sales where the seller allows the buyer to take ownership early, subject to conditions.
๐น CONTRACT TO SELL
Here, the seller retains ownership until the buyer completes payment or meets agreed conditions. No ownership transfer until obligations are fulfilled.
โ
Best for: Installment payments or financingโprotects the seller until full payment is made.
โ๏ธ REMEMBER:
Choosing the right document helps protect both buyer and seller. Donโt sign anything without understanding its legal effect.
