As you all know, Garga Chatterjee of Bangla Pokkho has recently been arrested under certain charges.
But those who are demanding his release should also know that if citizens across Bengal who allegedly suffered harassment, intimidation, hate-driven targeting, regional discrimination, psychological pressure, or public humiliation due to the campaigns and statements associated with Bangla Pokkho start coming forward, then several other constitutional and BNS-related provisions may also deserve legal examination and investigation.
The following provisions may be examined by authorities on the basis of complaints, evidence, videos, speeches, social media posts, victim testimonies, and organised activities allegedly affecting non-Bengali communities and social harmony:
• Article 14 of the Constitution of India
— Right to Equality before law
• Article 15 of the Constitution of India
— Prohibition of discrimination on grounds of language, place of birth, caste, community, etc.
• Article 19(1)(d), 19(1)(e) & 19(1)(g)
— Freedom to move freely, reside, and work anywhere in India
• Article 21
— Right to Life, Liberty, Dignity & Peaceful Living
Possible examination under BNS provisions including:
• BNS Section 196
— Promoting enmity, hatred, ill-will, or disharmony between regional/language groups (Apni Law)
• BNS Section 197
— Assertions prejudicial to national integration and denial of equal citizenship rights to a class/community (YouTube)
• BNS Section 351
— Criminal intimidation, fear creation, and threats (where applicable based on evidence) (The Times of India)
• BNS Section 353(2)
— Statements or misinformation allegedly creating hatred, fear, or public disorder (where applicable) (The Times of India)
If you or your family were directly or indirectly harassed, threatened, humiliated, targeted, discriminated against, mentally disturbed, or socially affected by such campaigns, statements, or activities, then this is the time to raise your voice constitutionally and democratically.
