A Mandamus Application is a powerful legal remedy used when the Department of Home Affairs has failed to make a decision on a visa, permit, waiver, exemption, or appeal within a reasonable time.

In South African law, government departments must act lawfully, reasonably and procedurally fairly. This duty comes from section 33 of the Constitution and the Promotion of Administrative Justice Act, commonly known as PAJA.

When an application remains pending for months or years without a clear decision, the delay may become unreasonable administrative conduct. A Mandamus Application asks the High Court to compel Home Affairs to finalise the matter.

It does not ask the court to approve the visa automatically; it asks the court to order the Department to perform its legal duty and make a decision.

This remedy is especially important for applicants whose lives, work, studies, families, or businesses are affected by long delays.
