In Victoria, one of the biggest early questions in any SDA development is whether the land requires town planning approval.
Town planning is the council approval process that looks at whether a proposed development is suitable for the land. The council will usually review things like zoning, overlays, neighbourhood character, parking, access, design response and whether the proposal complies with the local planning scheme.
For many residential developments, the town planning process can take around 6 to 8 months, and sometimes longer if there are requests for further information, objections, design changes or referral requirements. However, in Victoria, Clause 52.22 of the Victorian Planning Provisions may assist certain Specialist Disability Accommodation projects.
Clause 52.22 relates to Community Care Accommodation and can allow qualifying SDA developments to avoid the standard planning permit pathway. Where a site properly qualifies, the planning process may be shortened significantly, sometimes from 6 to 8 months down to approximately 1 to 2 months for council confirmation or exemption review.
The key point is that not every SDA site automatically qualifies.
Generally, the land needs to be in a suitable residential or approved zone, and there must not be planning overlays or controls that separately trigger a planning permit.
Common issues that may stop a straightforward Clause 52.22 pathway include:
• Flood overlays
• Bushfire management overlays
• Heritage overlays
• Aboriginal cultural heritage requirements
• Environmental or vegetation overlays
• Other planning controls that trigger a permit
The project also needs to be properly structured as SDA, including involvement of a registered NDIS provider, SDA Design Standard compliance, and certification by an accredited SDA assessor.
This is why early feasibility is so important.
Before purchasing land or committing to a project, developers should check:
• The zoning of the land
• Whether any overlays affect the site
• Whether the proposal meets Clause 52.22 requirements
• Whether a planning permit is still triggered by another control
• Whether the SDA design and provider structure are correct from the beginning
Clause 52.22 can be a very useful pathway for SDA developments in Victoria, but it needs to be assessed carefully on a site-by-site basis.
