Failure to secure and insure property can result in the Executor being personally liable to the beneficiaries for any damage and resulting loss in the value of the property.

We have seen, in the past, Executors failing to obtain the appropriate insurance because they wrongfully believe it’s an expense they must bear out of pocket. In reality, insurance is an expense of the estate, premiums can either be paid out of the estate funds or the Executor can pay personally and be reimbursed from the estate once probate (if needed is granted).
