🏗️⚖️ Developers are getting crushed in court… and for reasons you wouldn’t expect.
If a buyer can’t close on a pre-construction condo, here’s what normally happens 👇
❌ You lose your deposit
💰 The developer can sue you for the difference if the unit sells for less
But here’s where things get interesting 👀
Many developers are losing these cases because they failed to properly follow disclosure rules.
📄 Buyers are supposed to receive disclosures during the 10-day cooling-off period
✍️ Developers also need proof those disclosures were actually delivered
If they don’t?
⚠️ Courts may rule that the cooling-off period never officially started — meaning buyers could potentially walk away from the contract.
Some developers allegedly buried changes in update emails instead of properly disclosing them… and courts are not loving that.
💭 The message from the courts seems pretty clear: transparency matters.
If you’re stuck in a difficult pre-construction situation, this could be something worth exploring with a good lawyer.
