تقرير حول انتهاكات ضمانات المحاكمة العادلة بحق مهاجري جنوب الصحراء في ليبيا

يوثق هذا التقرير تكرار انماط معينة من الانتهاكات الموجهة ضد المهاجرين المنحدرين من دول جنوب الصحراء، وكذا المتقاضين الأجانب في إطار منظومة العدالة الجنائية الليبية. وتتوزع هذه التجاوزات على طول السلسلة الإجرائية، حيث تبدأ الانتهاكات من مرحلة القبض والاستدلال، وتمتد إلى التحقيق أمام النيابة العامة، ثم إلى جلسات المحاكمة.

و تتمثل المظاهر الإجرائية لهذه الانتهاكات في الإخلال بضمانات المحاكمة العادلة، مثل غياب آليات الترجمة الفورية للمتقاضين ، وضعف السبل للتمتع بالمساعدة القانونية وتوكيل محام، وتأجيل الجلسات بشكل متكرر، والتمديد غير القانوني لمدد الاحتجاز. وتتكرر هذه الممارسات بصفة ملحوظة في مناطق جغرافية معينة على غرار سبها وفي عدد من الدوائر الجنائية بمحكمة استئناف طرابلس.

وتشير المعلومات الميدانية، إلى أن هذه الاخلالات تسلط بشكل أشد على مهاجري جنوب الصحراء، لضعف تمكنهم من اللغة العربية، وصعوبة النفاذ الى المعلومات المتعلقة بقضايا تخص الأجانب، والأخطاء المتكررة في كتابة الأسماء غير العربية، إضافة إلى الخوف من توثيق هذه القضايا أو المعلومات المتعلقة بها، في ظل خطاب عام يربط الدفاع عن حقوق المهاجرين بقضية “التوطين”.

لا يفيد هذا التقرير بالضرورة بوجود سياسة معلنة تستهدف هذه الفئة، لكنه يرصد انماطا وممارسات عملية على أرض الواقع، تؤدي إلى أثر غير متكافئ على المهاجرين
