Sad News, P&O Ferries have today ceased all sailings and all ships have been told to remain in port. They are also making 800 crew redundant with immediate effect. It looks like P&O Ferries could well be in big trouble! This does not impact on P&O Cruises who are a totally different entity owned by Carnival Corporation.
IMPORTANT ANNOUNCEMENT: Some guests are saying that their credit card company will not pay out on the cashback scheme. Regardless of the type of credit card it is the card machine company that pays out, in Visions case, Barclaycard, so even if you have a Virgin card or a Santander card it is the card machine company that pays out. We can confirm that to date Barclaycard has so far paid out £71,000.00. So the precedent has been set, all of this money has been paid without a letter from an administrator, therefore it is the card company that do not want to pay even though they claim back through Barclaycard the machine operator.
IMPORTANT ANNOUNCEMENT RE VISION GETAWAYS
This is a highly important announcement regarding reimbursement for holidays, provided by Vision Getaways. Firstly, and contrary to the belief of some, Vision Getaways was a privately owned business and not a Limited Company. This means that as owner of the company I am personally liable for any debts accrued and as such it is wholly in my interest to seek a positive outcome for my many loyal Guests.
There has been much mention about insolvency procedures and our insurer not willing to progress claims at this time. This company were employed as insurers in the event of such unforeseeable situations. Unfortunately, procedural matters and insurer’s fine print are hindering progress for everyone at this time.
Having sought professional advice in regards to the best way forward, the following options are being considered.
Option 1. Declare personal bankruptcy, potentially leaving me devoid of all existing debt and everyone else without any chance of recovering their losses. In the event of any tangible assets becoming available, these would automatically go to those who are owed the most first i.e. banks and major suppliers. This is not by any means my first choice, however remains on the table.
Option 2. Is to enter into an Individual Voluntary Arrangement (IVA) which involves a third party evaluating and negotiating a payment plan to individuals, based on my income and affordability. This in itself could take many years to pay off owing to the number of people affected. However, with no current income or any available assets on either a personal or business level, this will be difficult to progress at this stage. However, I remain optimistic and am working hard to restore an income in the hope that an IVA may become a viable option.
Option 3. This is most likely the best option if you paid for your holiday or trip using a credit card (not debit card). Under Section 75 of the Consumer Credit Act 1974, the credit card company is jointly liable for any breach of contract by the retailer or trader. In this instance a failure to deliver your trip or holiday. This means it is just as responsible as Vision Getaways for the goods or service supplied, allowing you to also put your claim to the credit card company. You can make a claim to both the retailer and credit card provider simultaneously, although you can't recover your losses from both. This right is particularly useful if the retailer or trader has gone bust, as is the case with Vision Getaways.
I will continue to provide updates as they become available and remain committed to helping people where I am able.
Sadly, I also need to remind people that any form of hatred, threats, discrimination or homophobic negativity will not be tolerated. Regrettably, Essex Police have already been involved in such an instance.
