In early June 2025, the Scottish Government confirmed plans for new legislation to formally recognise digital assets – such as cryptocurrencies and online accounts – as a new category of personal property.

The proposed Digital Assets Bill, expected by the end of the parliamentary year 2025-2026, follows a 2024 consultation in which 85% of respondents supported clearer laws in this fast-evolving area.

Until the law comes into effect, executors are strongly advised to seek expert probate guidance. This can help with valuing cryptocurrencies, uncovering overlooked online assets and managing digital liabilities like cloud storage subscriptions. With further legal change likely, it’s vital for executors to stay informed and meet their evolving duties with confidence.

When there’s no Will, there’s still a way!

When former First Minister of Scotland, Alex Salmond, died unexpectedly in 2024 without a Will, it left behind not just personal grief, but public legal complications. His widow, Moira, faced a longer and more stressful process over access to his estate – a situation made more complex by the lack of written instructions.

Sadly, this isn’t unique to public figures. If someone dies without a valid Will in Scotland ('intestate'), their estate is distributed using a strict legal order. Long-term partners not in a legal union may receive nothing, and the process of obtaining Confirmation can be slow, costly, and complex. Furthermore, if the estate is worth more than £250,000, then it means a solicitor will have to manage the entire administration process.
