Recent research by Uswitch suggests more than 4 in 5 professional drivers say they've driven whilst tired and more than half said their employer could do more to support them with managing tiredness on the road - does your business recognise and have a plan to manage driver fatigue?

Employers have a legal duty to manage foreseeable risks, and fatigue is right at the top of that list. A crash involving a tired driver doesn’t just endanger lives; it can expose your business to criminal and civil liability, especially if there’s no clear policy in place.

In our latest legal briefing, we explore:
✔️ What the law requires of fleet employers
✔️ Why “just telling drivers to get enough sleep” won’t cut it
✔️ How to build a fatigue policy that holds up in court
✔️ What to do right now if your policy is outdated or non-existent

Mental health might be invisible but its legal impact isn’t.

This week is and for the transport industry - where over 95% of the workforce is male, mental health too often becomes the elephant in the cab. Yet for fleets, ignoring it isn’t just a wellbeing issue, it’s a legal one.

⚠️ 95% of the logistics workforce is male, a demographic statistically less likely to disclose mental health struggles (Source: British Safety Council, 2023)

⚠️ 30% of illnesses in the transport and logistics industry are mental-health related, according to self-reported data - the real figure may be even higher (Source: MIND, cited in British Safety Council, 2023)

⚠️ 44% of professional truck drivers have suffered from depression, and 1 in 5 rate their mental health as poor (Source: SNAP, 2024)

⚠️ Poor mental health contributes to fatigue, which is estimated to be a factor in 10–20% of all road crashes (Source: Brake, road safety charity)

Now consider this: if a driver involved in a serious incident says, “I’ve been feeling low, but no one asked,” investigators may scrutinise not just the driver, but your company. Were systems in place for disclosure? Were personal circumstances accounted for during shift planning?

If an employer failed to consider known mental health risks that contributed to a crash, that’s not just poor practice, it may be considered negligence.

At LMP Legal, we help fleets move from checkbox compliance to real-world duty of care as the legal consequences of ignoring it can be substantial.

Would your team know what to say or do if a driver raised a mental health concern?
