For the first time, the package introduces an EU-wide antisuit injunction mechanism. EU Member State courts can now order Russian parties to halt retaliatory proceedings brought in breach of arbitration agreements and impose substantial financial penalties for non-compliance.

Partner Becca Hogan and Associate Adriano Stagni examine the first substantive case management decision in the Talc Group Litigation, following the High Court’s recent judgment in Fuschillo and others v Johnson & Johnson.

Becca and Adriano discuss the Court’s order that the proceedings should be managed through a Group Litigation Order (GLO), considering the wider debate about whether the GLO regime remains the most efficient tool for large-scale litigation.

Their commentary also explores the judicial criticism of aspects of the claimants’ pleadings, and the procedural advantages secured by the defendants as the litigation moves into its next phase.
