Many of you who've attended our Employment Law update sessions this season will have heard us talk about "fire and re-hire" and the Code of Practice that was introduced a few months ago. The Government have now added that failure to inform and consult for redundancy collective consultation purposes is included in the 25% uplift for failing to follow the Code.

This will apply from 20 January 2025 - which means that employers considering the financial risks for failing to comply with their collective consultation obligations in a redundancy situation will now not only have to factor in a protective award of up to 90 days pay, but also a 25% uplift on the protective award.
