Extension to Company Annual Validation Deadline 📌
The Companies (Annual Validation) (Amendment) Regulations, 2021 were passed yesterday by the Committee for Economic Development. The effect of these regulations is to extend the deadline for filing company annual validation submissions for this year from 31st July to 31st August.

Guernsey Registry has said they appreciate that the changes to the annual validation form for this year combined with some unreliability on their online system, has caused some problems for users and it is hoped that this extension will help allow users to make their remaining submissions more easily.
Penalties for later submissions are:
£250 up to one week
£500 for one week to one month
£1000 for one month or more
So, you don't want to forget this, especially as these penalties start to apply from 1st September.

A recent self-isolation breach case in Guernsey resulted in a four-week suspended prison sentence and a £3,500 fine.
Originally offences under the Emergency Powers (Coronavirus) Regulations were only punishable with a fine, but now the maximum penalty is a fine and up to three months imprisonment.

Deadline for registration with ODPA nearly up!
If you are a business or organisation using people’s personal data you need to register with the ODPA by Sunday, 28th February. That means today is the last working day left in which to make or progress an application for registration.
The registration process is simple and only takes a few minutes. Aside from your name and address, there are just five questions to which YES/NO answers are required, and one question as to whether more or less than 50 employees.
The first YES/NO questions are whether you are a Controller (YES/NO) or a Processor (YES/NO) (which we covered in a recent post). The next two questions are whether you are a charity or not for profit organisation (in which case no fee is payable) and whether you are a States Deputy. You will know the answer to this one!
Then it is the questions about the number of employees and whether you have a DPO (which we have also covered in a recent post).
That’s it. Having answered these questions it is just a case of paying the fee (if applicable) to complete your registration. It is important to understand though that completing your registration does NOT mean you have completed all the legal requirements of data protection compliance. To do that you also need to have all the required policies and procedures in place.
