(6) संवैधानिक उपचारों का अधिकार (अनु. 32) –
अनुच्छेद 32 के अनुसार यह अधिकार मौलिक अधिकारों के लिए प्रभावी कार्यवाईयाॅं न्यायलय के द्वारा करवाता है । इस अधिकार के तहत यदि किसी व्यक्ति के मौलिक अधिकार का उल्लघन हुआ है तो वह सीधे सर्वोच्च न्यायालय में जा सकता है ।
अनुच्छेद 32 को डाॅ. भीमराव अम्वेडकर ने भारतीय संविधान की आत्मा कहा है।
अनुच्छेद 32 के तहत सर्वोच्च न्यायालय को और अनुच्छेद 226 के तहत उच्च न्यायालय को मौलिक अधिकारों के संरक्षण हेतु 5 रिटे जारी करने का अधिकार है –
6) Right to Constitutional Remedies (Article 32) –
According to Article 32, this right gets effective proceedings for fundamental rights done by the court. Under this right, if a person's fundamental right has been violated, he can go directly to the Supreme Court.
Article 32 by Dr. Bhimrao Amvedkar has called it the soul of the Indian Constitution.
The Supreme Court under Article 32 and the High Court under Article 226 have the right to issue 5 writs for the protection of fundamental rights –
