A lady had lodged complaint against a person alleging that he r***d her by threatening her. High Court affirmed the conviction and sentenced him to undergo imprisonment for seven years. Further, in the Supreme Court the bench set aside these concurrent convictions by the following reasons:
• The complainant was not examined by the doctors after the alleged incident.
• Similar types of complaints were being made in the past by complainant against other persons also, later found false.
• There was no eye witness to the alleged incident.
• It had also come in evidence that complainant has a habit of making wild allegations of such nature against those persons with whom she or her husband were having any kind of dispute.
