What is the cooling off period?

Cooling off period is the time given by the Court to the husband and wife after filing of the petition to obtain uncontested divorce to make up their minds and to decide if they want to continue with the divorce proceedings. This period is intentionally given to the parties by the Court to maintain the sanctity of marriages and to prevent any divorce which was initiated on grounds of a heated argument or dispute.
This cooling off period can be waived off by the Court if it finds it appropriate in accordance with the scenario of the case in hand.

Section 13-B of the Hindu Marriage Act,1955 deals with the divorce by mutual consent.
⚫️ When both the Husband and the Wife mutually agree that they cannot live together any more, and they have come to a realisation that the best solution for them is getting a Divorce.
⚫️ When the couple has amicably resolved their terms of separation to part ways, they would present a Mutual Divorce Petition jointly before the Hon'ble Court, without putting forth any allegations which they might have against each other.
⚫️ The Hon'ble Court will take their petition into consideration and may even offer for hearings of mediation, which could have the couple mending their hearts or may part their ways at the end of all the sessions if they remain firm on their decision!⚪️
