Over 30 of us gathered for the first session of our Construction sector seminar series, with guest speaker Mr. Yassin Doolaur, Vice Chair of the FIDIC Membership Committee.

A few takeaways:

→ FIDIC 2017 makes dispute avoidance the mandate, not resolution
→ In Mauritius, DAAB and mediation clauses are routinely struck out — disputes still end up in court
→ Force majeure is narrower than most assume; even sustained fuel price hikes don't qualify
→ The numbers in FIDIC (28, 56, 84 days) are never arbitrary
