Mediation Course:
Hi guys, our Arbitration Dispute Resolution Services Center will implement a Mediation Course starting on this year 2023 in Kuching, Sarawak.
So are u guessing what is a Mediation? What is and how does it function? What will this course provide? How does it benefits us?
Okay. Let me briefly go through with you.
A Mediation (governed under Mediation Act 2012) is a unique and professional skill to assist, advice and/or provide a way to resolve and/or settle a conflict or dispute peacefully. The Mediator will be the one who assist the disputed parties in a mediation.
A Mediator is a kind of professional occupation who can be appointed by anyone, anybody or any party(s) who has the right to listen, consult and function as “middle-man” or “Neutral“ without bias and any conflict of interest which is governed under the Code of Conduct for any simple dispute case(s) refer before him through the concept of ‘Alternative Dispute Resolution’. In other words, it resolves a dispute through peaceful negotiation and conciliation which enables the disputed parties to accept and agree to the resolution provided. Any type of disputes and/or cases can be brought before a Mediator except for Criminal cases. All the dispute cases and any communication shall be kept in confidential according to Section 14 of the Mediation Act 2012.
An ‘Alternative Dispute Resolution’ is a concept of settling matters or disputes outside the court. It usually save cost, save time, less formal, and less stressful than court proceeding. This concept could be able to bond a healthy relationship between the disputed parties.
Last but not least, at the end of the negotiation between the parties, the disputed parties will then enter into a Settlement Agreement upon reaching for an agreement regarding a dispute which is binding on the parties and may be a consent judgement if any of the disputed parties wish to bring their case before the court after the end of mediation.
As such, through this course, u will be able to learn the role of Mediator and the function of the mediation; learn to negotiate, advice and provide effective and efficient resolution to resolve dispute(s); acquire knowledge to draft a Settlement Agreement.
