The unfortunate aspect about this story, in our view, is that it wrongly portrays cross-leas properties in a bad light, ultimately scaring people off buying because of scare-mongering about issues which very rarely eventuate any more than they might between any other neighbours. Don't be scared. The reality is that for hundreds of thousands of properties all over New Zealand, cross-leases have been a perfectly acceptable land share ownership arrangement for 30-40 years or more. Nor are they generally 'ticking time-bombs' or 'living hell', so it's a pity this dispute has ended up in the media as such. If it weren't for this ingenious type of legal property ownership (popular as a sort of 'subdivision' of large plots of land up to the early 1990's, but ceasing with the introduction of the RMA), our housing situation would be far, far worse. And is the usual 2-3 owner cross-lease any worse than living in a Unit Title with multiple owners? We very much doubt it! In fact we wonder why the cross-lease scheme isn't brought back to enable a cheaper avenue to free-up land and achieve housing in-fill.
