Atty., ako ang unang nakabili. Pero bakit sa iba naipangalan ang titulo? Pwede ba 'yun? Legal ba yun?

In the case of Spouses Bernardez v. Spouses Magtoto (G.R. No. 165888, September 14, 2007), sinabi ng Supreme Court na kapag ang isang immovable property ay naibenta sa dalawang magkaibang tao, ang unang nakapagparehistro ng sale sa Registry of Deeds ang siyang kikilalaning may-ari.
Ito ang konsepto ng "first in time, stronger in right."
Pero may catch.
Hindi sapat na ikaw ang unang nakapagparehistro. Kailangan din na ginawa mo iyon in good faith.
Ibig sabihin, wala kang alam na may problema o depekto sa karapatan ng nagbenta, at wala ring mga circumstances na dapat sana'y nag-udyok sa'yo na magsiyasat pa bago mo ipinatitulo ang property.
Kaya ang lesson dito?
Huwag maging kampante dahil lang may hawak kang Deed of Absolute Sale.
Ang deed of sale is only one step in acquiring ownership. Hangga't hindi pa naipapasa at naipaparehistro ang titulo sa pangalan mo, may mga legal risks na maaari pa ring mangyari depende sa facts ng bawat kaso.
Paalala lang. Protect your rights. Finish the process.
Sa pagbili ng lupa, hindi nagtatapos ang transaction sa pirmahan ng deed of sale. Mas mahalagang matapos ang buong proseso, mula pagbabayad ng tamang taxes, registration, hanggang transfer ng titulo sa iyong pangalan.

Out of all the cases received this week, ito ang isa sa mga interesting:
Q: Paano po pag may heir na hindi makapirma o pumirma sa Extrajudicial Settlement of Estate? ano po ang effect?
A: Par. 2, Sec. 1 of Rule 74 of the ROC provides:
"... BUT no Extrajudicial Settlement shall be binding upon any person who has not participated therein or had no notice thereof.
In other words, kung may heir na hindi nakilahok o walang kaalaman sa settlement, hindi automatic na bound siya ng kasunduan ng iba. Minsan, kahit naka-register na ang dokumento, may legal questions pa ring pwedeng bumalik years later.
Pero mas nagiging interesting ang discussion kapag ang isang co-heir ay pumanaw na rin. At that point, ang tanong ay hindi na lang kung sino ang pumirma, kundi kung sino na ngayon ang may karapatang pumirma.
Sa estate settlement, hindi lahat ng problema nakikita sa title. Minsan, nasa family tree.
Kaya bago magmadali sa pagpirma ng mga dokumento, magandang siguraduhin muna na kumpleto ang mga taong dapat kasama sa usapan. After all, in succession law, missing one heir can sometimes create more problems than having ten heirs.
