Latest Supreme Court Decision (2025): R**e Case Changed to “Consensual Adultery”
Originally the accused was convicted of r**e (Zina bil Jabr) with a 20-year prison sentence.
The Supreme Court overturned that conviction and said the case should be treated as consensual adultery (Zina bil Raza) instead.
The sentence was reduced from 20 years to 5 years’ imprisonment.
The fine was also reduced from Rs. 500,000 to Rs. 10,000.
If the fine is not paid, the accused will spend another 2 months in jail.

Why did the court change it?
The Supreme Court majority said the evidence did not prove r**e (which requires force or coercion). Instead, the court said the available evidence showed consensual sexual relations between the two adults.
Because of this, the court treated the case as adultery with consent rather than r**e.

One judge (Justice Salahuddin Panhwar) disagreed with the majority judgment and said the conviction should have stayed as r**e.

Important Legal Difference
Zina bil Jabr (r**e) = sexual in*******se without consent (very serious crime).
Zina bil Raza (consensual adultery) = voluntary sexual relations with consent (different offence in law).
The Supreme Court’s decision was controversial because it changed how the act was legally interpreted.
