Many people wrongly assume that simply living in a property makes them a “tenant.” Legally, that is not always true.
Here is a simple breakdown:
1. Lease
A lease is a long-term legal agreement.
Usually for a fixed term (e.g., 5, 10 years or more)
The tenant is given exclusive possession of the property
The landlord cannot evict the tenant without following due legal process
In short, a lease provides stronger legal protection and stability.
2. Tenancy
This is the most common arrangement in Pakistan.
Usually monthly or yearly rent agreement
The tenant has possession of the property
It can be terminated with proper notice
Less rigid than a lease and generally easier to end legally
3. License
This is where most confusion happens.
You are not a tenant
You are only given permission to use the property
Example: staying at a friend’s house or temporarily using someone’s space with permission
There is no legal possession involved
The permission can be withdrawn at any time
Simple Truth:
Not everyone living in a property is a tenant. Some people are merely licensees with permission to stay.
