How much can procedural rules really improve the way evidence is handled in arbitration?
Panel 6 will explore the various tools and procedural mechanisms for efficient and proportionate taking of evidence in arbitration — under the DIS Rules, but also in comparison with approaches under other institutional rules and widely used soft-law instruments.
The panel aims to move beyond theory and open a practical conversation — among speakers and with the audience — about what an arbitral institution can realistically do — through rules, guidance, templates — to help tribunals and parties conduct evidence-taking efficiently, without undermining due process or the parties’ right to present their case.

Damages are the ultimate battleground in Investor–State dispute settlement (ISDS). While liability attracts headlines, valuation evidence decides outcomes.
Panel 5 explores how tribunals assess damages claims: the methodologies, evidentiary burdens, and credibility of expert evidence that underpin billion-dollar awards. It will consider how legal standards interact with economic analysis, how tribunals distinguish robust valuations from speculative ones, and what evidentiary trends are shaping the evolving practice of quantum in ISDS. Recent work by UNCITRAL Working Group III has brought renewed focus to the evidentiary foundations of damages and valuation in ISDS.
