📣 Litigiile dintre beneficiarul unei autorizații de construire și terții care se pretind vătămați de acest act administrativ sunt printre cele mai comune în materia dreptului urbanismului.
Echipa noastră a obținut recent, într-o asemenea speță, o soluție favorabilă de respingere a unei acțiuni în contencios administrativ vizând anularea unei autorizații de construire, prin admiterea excepției tardivității.
Instanța a confirmat astfel că terții potențial vătămați de un act administrativ nu-l pot ataca oricând, trebuind să manifeste un comportament diligent în aflarea conținutului actului, cu respectarea termenelor prevăzute de Legea nr. 554/2004 a contenciosului administrativ.

📣 Disputes between the beneficiary of a building permit and third parties who claim damages due to the issuance of this administrative act are among the most common in the field of urbanism law.
Our team has recently obtained, in such a case, a favorable solution whereby the court of law rejected an action for the annulment of a building permit, by admitting our arguments on the grounds of late submission of the complaint.
The court thus confirmed that potentially damaged third parties due to the issuance of an administrative act cannot challenge it at any time, having to behave diligently in finding out the content of the act, in compliance with the time limits provided by Law no. 554/2004 on the administrative litigation.
