Big FYI — I know everyone says to read the fine print in a contract. Here is one instance when you definitely want/need to. If you or as a realtor, your client wants a new or custom built home, you will find that each builder uses their own contracts and not those promulgated for TREC or similar. Some builders may include a NDC in the fine print. NDCs, or non-disparagement clauses, are a type of “gag order,” barring a buyer from saying or posting disparaging remarks. This could be a red flag, or at the very least warrant a discussion. I see both sides of this debate.
