Call To Action Podcast
Attorney Steven Leahy sounds the call to action in a podcast directed at solving IRS issues. This podcast helps list ends take their life back!
One of the biggest sources of confusion right now is the difference between a 1099-NEC and a 1099-K, and it's driving a surge in IRS notices.
The 1099-NEC is for direct payments to contractors.
Non-employee compensation. They changed the rule, it used to be the 1099 miscellaneous.
The 1099-K is for payments processed through a third-party platform, like credit cards or Venmo.
Sometimes both forms get issued for the same income. That's the problem.
You need to understand how your payments are being processed, because the form matters.

Worker Misclassification
The IRS doesn't care what you call someone. They care how the relationship actually works.
They look at three things, behavioral control, financial control, and the relationship itself.
Who controls the work? Who provides the tools? Is the person economically independent? Do they have other clients? Is there a contract?
You can have a perfectly drafted independent contractor agreement and still lose, because the facts don't match the document.
Classification is not a form decision. It's an operational decision. And if your operations don't support your classification, you're exposed.
Save this if you have contractors working for you.
