Congratulations to Matthew Turkalj and our Medical Malpractice group on a significant recent victory before the Ohio Supreme Court on behalf of our OB/Gyn client who was baselessly named in a lawsuit and forced to endure prolonged litigation before being dismissed from the case by the Trial Court.

The Court found there was no admissible evidence to support the claims against our client, and granted summary judgment in his favor. Plaintiff appealed that ruling, relying on an affidavit that was executed by her OB/Gyn expert in an effort to defeat our dispositive motion, which the Trial Court previously struck as a “sham affidavit.”

The Court of Appeals affirmed the dismissal, as did the Ohio Supreme Court, ending years of meritless litigation against our client.

Perez Morris is very proud of this result and pleased that our client can finally put this matter behind him.
