New regulations in New York City now require grocery delivery platforms such as Instacart, Shipt, and FreshDirect to pay workers at least $21.44 per hour for active delivery time, excluding tips. This minimum wage, which already applies to restaurant delivery apps, is set to rise to $22.13 in April 2026 and will continue to adjust annually for inflation. The rules also mandate that platforms display tipping options upfront, defaulting to at least 10%, and issue weekly, itemized pay statements within seven days of the pay period.

Enforcement falls under the NYC Department of Consumer and Worker Protection, with potential fines of $500 per violation. In response to the new requirements, some apps have begun adding regulatory fees for NYC customers to offset increased operating costs.
