I am a board member and Attorney for a non profit group, angels surviving cancer, inc. I am reaching out to my network to cordially invite you to our 10th annual prayer breakfast. Don’t do this. Create a trust. Any asset that goes to a child should be in a trust. Why you ask? Great question. (1) Children cannot inherit. (2) you can create a revocable trust (that you control during your life) and can add to it as you see fit. Upon your death you won’t need to do ANYTHING. Everything will already be set up for them. There are many different type of children’s accounts out there but a true is the best way to start building their future for them.

To go or not to go to trial?

Look I know everyone thinks they should “have their day in court” but I’m telling you as an attorney it’s not always worth it. Timewise and moneywise. Did you know that 95% of cases settle outside of court either through mediation or some other settlement relief?

I mean sometimes it’s about principle so I get why you may want to appear before a judge or jury but sometimes you can get what you want if you just ask for it.

I always tell my clients you won’t always win in settling just like you won’t always win in court. It’s about what you can live with. So ask yourself is settling for this something I can live with? Will it make me, hurt me a little, or break me? I always say if it don’t break you it ain’t worth it.

A lawyer on my timeline asked why aren’t there more marriage attorneys?

There is no such thing as marriage attorney. There really isn’t a thing for divorce attorneys either. The practice is called family law. Family law encompasses all of the following:

Divorce
Marital property
Child custody
Child support
SAPCR
Modifications
Marital agreements
Enforcements
Termination/adoptions
Protective orders/restraining orders

Your family law lawyer should be able to do all of these. If not, throw the whole lawyer away. You cannot claim to practice in a particular area and not know as much as you can about that practice area.
