To Whom It May Concern,

I want to extend my sincere appreciation for the diligent efforts of the Texas Education Agency (TEA) in implementing the outlined changes to Chapter 89. I commend TEA's commitment to modernizing the language and requirements of the administrative code, and I am particularly grateful for the recognition of the title "school psychologist" for individuals holding the Licensed Specialist in School Psychology (LSSP), in alignment with 22 TAC Chapter 465.

I fully support the proposed changes to §89.1050, §89.1055, and §89.1131, as presented.

In regard to the proposed amendments to §89.1040, while I endorse the suggested modifications, I respectfully urge TEA to consider aligning the Developmental Delay eligibility age range to 3-9 years, consistent with federal regulations. This alignment would facilitate a smoother transition process for students and families relocating to Texas, eliminating the need for extensive procedures to meet differing state eligibility requirements.

Regarding the proposed changes to §89.1011, I generally support the majority of revisions but express reservations concerning §89.1011(h). Requiring a Local Education Agency (LEA) to furnish a copy of the Full Initial Individual Evaluation (FIIE) when issuing initial notice of the ARD meeting may pose logistical challenges, particularly for districts coordinating initial ARD meetings well in advance with parents. To address these concerns while ensuring meaningful participation from parents, I propose the following revision to the paragraph:

(h) A copy of the written FIIE report must be provided to the parent no later than 5 school days from the date of the FIIE report, or not later than June 30 if subsection (e)(1) of this section applies.

This adjustment would enable LEAs to fulfill their obligations while affording parents ample time to review the FIIE before their initial ARD meeting.

In conclusion, I wholeheartedly support many of the proposed changes by TEA and urge your consideration of the recommendations outlined in this correspondence.
