If you are already in the United States on a visa, this may be important for you. A lot of people assume the EB-3 program is only for individuals applying from outside the country.

That is not always the case.

In some situations, individuals who are currently in the U.S. on valid non-immigrant visas (such as F-1, H-1B, or similar categories) and have maintained their legal status may be eligible to pursue permanent residency through a process known as Adjustment of Status.

This means the immigration process can, in certain cases, be completed without leaving the United States.

That said, eligibility depends on individual circumstances, timing, and visa history, and every case is different.

The EB-3 process itself still takes time, typically 2–4 years, and involves employer sponsorship and government adjudication.
