Children are victims of domestic abuse in their own right under Section 3 of the Domestic Abuse Act 2021. Yet too often, the family courts continue to treat domestic abuse as a dispute between parents rather than recognising the profound harm inflicted on children who live with, witness, or are affected by abuse.

A child does not have to be physically assaulted to be a victim. Seeing, hearing, or experiencing the effects of domestic abuse can have lifelong consequences. The law recognises this. The courts must too.

Children’s safety, welfare and voices should never be secondary to preserving parental contact at all costs.
