After three years and three wins, we finally won our client’s case for withholding of removal (like asylum) for good yesterday and he is at last being released from detention to reunite with his family. We won the case two years ago in immigration court. DHS appealed to the Board of Immigration Appeals and the case was remanded back to the same judge. The judge granted a second time and DHS appealed again to the BIA. Finally, yesterday, we got the decision that the case would just be remanded to clean up security clearances and that our client would be released on Monday. This client, many times, wanted to give up his case and just be deported. The immigration judge himself could not imagine why DHS would appeal the case twice. We repeatedly sent briefs to DHS to plead for our client’s release as a matter of prosecutorial discretion and he remained detained.

We are very grateful for this win and to our team – every person in the immigration practice has worked with this client and the mom left behind with children to support.

TPS DESIGNATED FOR UKRAINE!!!!!!!! For all Ukrainians in the US as of March 1, 2022, they will be eligible to apply for Temporary Protected Status. The duration will be 18 months with a work permit and even persons with deportation orders may apply.

This is excellent news and sends a strong message to the world about the humanitarian gravity of the situation in Ukraine.
