As per the Visa Bulletin (February 2026), Indian nationals face multi-decade waits in EB-2 and EB-3 categories.
Against this backdrop, EB-5 has emerged as a structurally different proposition for Indian investors. According to USCIS filing data analyzed by IIUSA, Indian-born EB-5 investors accounted for one of the fastest-growing shares of post-Reform and Integrity Act (RIA) filings, particularly in the Rural EB-5 Project category.
In some cases, Indian investors in Rural set-aside categories have received I-526E approvals in under 12 months based on post-RIA processing trends, although timelines vary and are not guaranteed.
Why EB-5 May Offer Faster Processing for Indian Investors post-RIA of ‘22?
• Investment in Rural EB-5 Projects - 20% of all EB-5 visas are reserved annually specifically for Rural investments
• Set-aside visas - 32% of EB-5 visas are now reserved annually across three categories: 20% for Rural EB-5 Projects, 10% for high-unemployment areas, and 2% for infrastructure investments
• Concurrent filing - Allows U.S.-based EB-5 investors to submit both the immigrant petition (Form I-526E) and the adjustment of status application (Form I-485) at the same time
