Some cases are about more than legal arguments—they’re about making sure workers have a fair place to be heard.
In Lynn v. BNSF Railway Company, MSB Founding Partner Chris Moreland, alongside Paula Jossart, represented injured railroad worker Tanner Lynn in a dispute over where his case could be heard. At the heart of the matter was Minnesota’s consent jurisdiction statute and whether it could be used to hold a major employer accountable in the state where it does business.
After favorable rulings in both the trial court and the Minnesota Court of Appeals, BNSF petitioned the U.S. Supreme Court to review the case. On May 4, 2026, the Supreme Court declined to grant review, leaving those rulings intact and allowing Mr. Lynn’s case to move forward in Minnesota.
It’s a meaningful outcome for one client—and a reminder of the broader principle MSB fights for every day: access to justice should not disappear when a case involves a powerful employer.
For more than 25 years, Chris has built a reputation for taking on some of the country's largest employers and fighting for justice on behalf of workers. This case is another example of MSB's commitment to advocating for employees at every level—including in proceedings that reach the U.S. Supreme Court.

Can your employer retaliate against you for asking to see your personnel file?
In his latest blog, MSB Employment Justice attorney Colin Pasterski answers this common question and explains the rights Minnesota employees have when it comes to accessing their personnel records.
Many workers are surprised to learn that Minnesota law generally gives current and former employees the right to review their personnel files, which may include performance evaluations, disciplinary records, and other employment-related documents. Yet employees often hesitate to make a request because they worry it could lead to negative treatment at work.
Colin's article breaks down what employers are required to provide, the timelines that may apply to personnel file requests, and the legal protections available to employees who exercise their rights.
Understanding what's in your personnel file can be an important step in protecting your interests and staying informed about your employment record.
