As the Sept. 28 trial date approached, counsel for the plaintiff faced several potential obstacles, said David Mazie of Mazie Slater Katz & Freeman, who represented the child along with the firm's Beth Baldinger and Trevor Dickson.
The obstacles surrounded the state employees misconduct, the plaintiff's claim for negligent supervision, and the father's role in liability, among other issues.
"There was damning evidence, and I think that a jury could have been very angered by this, and potentially punish the defendant," Mazie said.
John D. North of Greenbaum, Rowe, Smith & Davis in Woodbridge represented the state defendants.
