While an employee may be going back to work, workman's comp may be needed to pay the difference in what the worker was originally making and what he or she is making after the injury.
The American Medical Association (AMA) routinely publishes the "Guidelines to the Evaluation of Permanent Impairment," which helps establish whether or not a work-related permanent injury falls within these guidelines. A doctor is required to evaluate you based on these guidelines.
Always remember, that your employer is not entitled to pay your medical bills directly. Any such payments need to be routed through the Worker’s Compensation carrier.
How does my employer decide on a settlement offer for my injury at work? That can be very complicated to understand and one of the reasons workers should consult with a worker’s compensation attorney. Basically, under the law in most states, the worker is offered a settlement based on the degree of disability that remains after maximum medical improvement is reached.
We realize that it can be difficult to admit when your own actions may have contributed to your current work-related injuries. Let’s talk about what happened leading up to your accident and whether your role in things could hurt your case.
Have you heard about Social Security Disability Insurance (SSDI)? Under this eligibility, you may be allowed to receive Medicare benefits after a waiting period, irrespective of your age.
