When someone passes away in Texas, the probate process typically involves retaining a qualified probate attorney to initiate and manage the court proceedings.

Probate is a court-supervised legal process, and filings must comply with Texas statutes and local court requirements. In many estates, an attorney prepares and files the application to begin probate in the county where the deceased resided.

If a will exists, the original document is located and submitted to the probate court for review and validation.

Until the court grants authority to an Executor or Administrator through official Letters issued by the court, real property remains titled in the deceased’s name and cannot legally transfer.
