In most cases, a bail bondsman will take out a security against a defendant’s assets to cover the cost of the bail. If the defendant doesn’t have enough assets, then the bondsman might take out securities against friends and relatives willing to assist.

Bail bonds are actually as old as America itself. In fact, Colonial America emulated English law when it came to bail-related matters until after 1776, when the Declaration of Independence enabled courts to enact their own version of bail and bond laws.

The reason that bail bonds exist is because trials can take weeks or even months to work their way through courts and bail allows a potentially innocent defendant to wait for his or her trial at home.
