How can a Policyholder rescind an AOB (Assignment of Benefits) contract?
Our hearts go out to those in the wake of Hurricane Ian, especially those who unknowingly signed an Assignment of Benefits contract. Many questions are coming in from policyholders that realized they reluctantly gave away certain rights and benefits as an insured by signing an AOB. But don't worry - there are provisions in Florida law allowing policyholders to rescind these contracts and regain full control of their claim process. If you do rescind a contract, please send a copy to your insurance company’s interior adjuster.
STEPS TO RESCIND AN AOB CONTRACT
Written notice to rescind the contract may be submitted to the third party:
1. Within 14 Days after executing the AOB contract
2. At least 30 days after the date the third-party vendor is scheduled to start work, if that vendor has not already completed a substantial amount of the work
3. At least 30 days after executing the AOB, if the AOB does not have a start date for the work and the third-party vendor has not begun substantial work on the property.
If you have questions, please call us. We are hearing from insureds they had unknowingly signed away their rights to contractors and public adjusters. Please read all contracts thoroughly and take your time to review before signing. If something sounds too good to be true, it probably is. There are many great companies out there ready to work but unfortunately, there are many that don't have the best interest of the homeowner in mind. These individuals operate by putting pressure on those who are already under high stress and took advantage of the situation.

An insurance village has been set up by Chief Financial Officer Jimmy Patronis and the Florida Department of Financial Services to assist residents with insurance claims and other insurance needs. It operates daily from 8 a.m. to 6 p.m. at the Port Charlotte Town Center Mall parking lot, 1441 Tamiami Trail, Port Charlotte.
Homeowners who need to speak with an insurance expert can also call 1-877-693-5236, 9 a.m. to 5 p.m. However, due to limited staffing, you are encouraged to visit the insurance village in person.
