With conflicting claims -and no witnesses- how does one prove fault in a motor vehicle case that involves a catastrophic injury?

THE CASE
The facts are clear: two drivers were in a collision on a single lane of travel. The plaintiff suffered a lumbar disc herniation requiring surgery. What’s in dispute is who is at fault.

The defendant testified he was prevented from moving forward on a single lane of travel because of a double-parked truck. When he veered to go around the truck, he was struck by the plaintiff.

The plaintiff contended there wasn’t a parked truck. He made a reasonable presumption that the defendant was about to double-park because his vehicle slowed down parallel to the curb. He continued around the defendant’s vehicle while maintaining his lane of travel.

THE RESULT
The plaintiff’s lawyer had LegalArsenal create multiple animations, presenting in mediation both the defendant’s version and the plaintiff’s version. The animations convinced the defense to the weakness of their argument. The result was an impressive settlement, the terms confidential.

LegalArsenal created this forensic animation to support our lawyer’s latest victory in a medical malpractice case against a major institution. The defendant admitted negligence before mediation and settled the case for a whopping $16,000,000!

THE CASE
A teenager died after physicians failed to treat a tumor that was pressing against his heart and airway. He underwent a chest x-ray that showed a potential mediastinal mass in the center of his chest. Yet, he was sent home.

Two days later, the teen suffered a cardiopulmonary arrest and died. His autopsy revealed that he had a form of cancer, a serious but otherwise treatable medical condition.

THE RESULT
The plaintiff lawyers sent the LegalArsenal animation to the defendants before mediation. A short time later, they not only settled the case but the institution admitted negligence!
