Washington Realtors… did you know this court case is the reason you can draft contracts? In this week’s WA Friday Broker Tip, Ken Sax, WA Designated Broker, CE Instructor, Education, and Governmental Affairs, explains Colton v. Heritage House (1987).
This Washington Supreme Court case allows brokers to draft contracts through a limited practice of law, but only if four important conditions are met.
Quick refresher for Washington agents:
•The transaction must be simple
•Use statewide approved forms
•Provide real estate services before drafting
•When drafting, you are held to the standard of care of an attorney
If you are drafting contracts in Washington, this is a rule every agent should understand.
