I wanted to update you all about some legal BUT highly unusual things happening at the California Department of Education (CDE) TOMORROW that, if passed, WILL GREATLY impact how we as homeschool families work with our charter schools!
The California Department of Education (CDE) and State Superintendent Tony Thurmond are proposing an extensive set of amendments to the laws that govern our non-classroom-based charter schools (homeschool charter schools). Usually, changes to our laws are passed through the legislative process at our state capitol, but the CDE is attempting to use California’s regulatory adoption process to change policy.
Items of Greatest Concern
• Expanding mandated board policy to include minimum time for live interaction and synchronous instruction: The draft calls for adding minimum time provisions to the already-extensive board policy mandate, which will be burdensome and could be interpreted to force a one-size-fits-all approach that students and families neither want nor need.
• Limitation on vendors: The proposed regulations state that vendors may “not be the primary provider” of independent study instruction.
• Additional consultation and signature-gathering mandate: The proposed regulations call for schools to “consult” with parents/guardians when making any amendments to written agreements and gathering new signatures. This is burdensome; it could delay teachers’ ability to amend students’ assignments and could preclude schools from generating attendance credit for funding purposes.
• Limits on credit for past-due work: The proposed regulations state that assignments submitted after the due date are eligible only for “academic” credit, presumably excluding attendance credit for funding purposes.

Process:
California’s regulatory adoption process is complex, arcane, and governed by its own rules. Governed by the Administrative Procedures Act, a set of laws in the Government Code that establishes the rules state agencies must follow when they develop regulations.
Key points to keep in mind:
• This is CDE’s initial proposal.
• CDE staff will take this week’s comments and issue a revised version in the future.
• We must speak up now with our concerns because, during future hearings, we must focus comments only on updates and not the entirety of the proposed changes.
• During the next round, there is a very short window for responses.
• Once CDE finalizes its proposed changes, it must submit them, along with a record of their responses to stakeholders, to the Office of Administrative Law (OAL).
• OAL attorneys review the proposed changes for consistency with the Administrative Procedures Act (APA) to ensure that regulations align with statutory and constitutional law and that regulations are not a “back door” way of amending them.
• If OAL rejects the proposed changes, CDE can re-amend them, again with a short timeframe for additional public comment.
• If/when OAL approves the proposed changes, they then become regulatory law.
Criteria that Matter:
The OAL is supposed to review the proposed regulations through several lenses, principally including that the law meets the following standards:
• Adequate authority and reference to law. The State Superintendent, per the Education Code, is authorized to adopt regulations governing independent study, so the “authority” standard is generally met. The regulations, however, should also have a basis in either statutory law (e.g., the Education Code) or other law (e.g., constitutional law).
• Consistency with other laws, meaning that the regulation is consistent with other controlling laws and doesn’t alter, expand, or amend them.
• Clarity, meaning that a normal human being would find it understandable.
• Non-duplication, meaning that the regulation doesn’t duplicate another regulation or law, and
• Necessity, meaning there is a clear need for the regulation.
We must take the time to make our concerns heard. Here is how you can help:

Tips:
• Briefly state your name, parent of # of kids, and school name if applicable.
• Briefly thank CDE staff for their work.
• Express general concern regarding the already-burdensome compliance requirements for independent study, especially concerning non-classroom-based charter schools.
• Briefly summarize your concerns (if any) with any proposed changes, ideally grounding them in one or more of the review criteria listed above (e.g., consistency, clarity, necessity, etc.)
• Note any proposed changes that you support (if any).
• CSDC wrote a letter outlining concerns for our schools so if you are not comfortable stating your own concerns, and especially if you’re uncomfortable speaking to the arcane details in a public hearing, feel free to state that you share the concerns CSDC has raised in its letter.
