I-9 Form Updates
To stay compliant with the new Federal immigration laws, employers should begin to use the new streamlined I-9 Form starting August 1st, 2023.
What's New?
✅ The new I-9 will be available on August 1, 2023.
✅ Employers must begin using the new I-9 form no later than November 1, 2023. If the old version of the I-9 is used after that date, the employer can be penalized.
✅ The new I-9 is only one page long to make it easier for both employees and employers. Other improvements include clearer instructions and providing guidance on acceptable documents and the auto-extension of certain documents.
Although the groundwork has been laid for permanent remote examinations to become a reality for all businesses based on the new regulation, the Department of Homeland Security (“DHS”) confirmed that only E-Verify using businesses who are in good standing may continue to conduct verifications electronically beyond August 1, 2023.
E-Verify employers performing remote verification must conduct a live video interview with the employee, retain copies of all documents presented in the I-9 verification process and create E-Verify cases for new employees.
All other businesses must change back to physical, in-person, inspections of documents to verify identity (either by the employer or an Authorized Representative using the DHS-authorized alternative procedures).
For our Vested clients, our HR system will be updated with the new I-9 form when released. Additionally, we will send the revised form to clients who prefer to use paper onboarding documents."
