Do you know that a Texas Notary Public cannot interpret, draft, or provide advice on the contents of a legal document unless the notary public is a licensed attorney? Doing so can constitute what is known as “unauthorized practice of law” or UPL.
Sometimes, customers will ask me for assistance in obtaining or completing documents such as wills, contracts or a power of attorney. Customers may assume that I am experienced in the preparation of these types of documents and that I can provide the assistance requested. Unfortunately, Texas law prohibits me or any other notary public from giving advice, or from the rendering of any service requiring the use of legal skill or knowledge (see Section 81.101 of the Texas Government Code). This includes things such as preparing a will, a contract or other types of legal instruments. This law is intended to protect you from the loss of money, property or liberty.

According to the Legislative Reference Library of Texas (LRL) many new bills passed during the 88th Texas Legislative Sessions will go into effect on September 1, 2023. A total of 774 bills and individual sections from 19 additional bills are scheduled to become law on this date. One of these bills is HB 255 which applies to Notary Publics and addresses an increase in the maximum fees a notary public can charge for notarial acts. Being a lifelong learner and always in pursuit of new opportunities, I decided to enroll in a certification program to become a Certified Notary Trust Delivery Agent (CNTDA). Took the course and the test and became certified. So, what is a Certified Notary Trust Delivery Agent? Well, thank you for asking. A CNTDA is a credentialed notary that has undergone advanced training and testing to better serve the public and estate planning professionals in the skillful presentation and ex*****on of trust documents.
