📍Who Pays for Title Insurance in Each Florida County?

🔑🤍 I send this reminder periodically because I continue to receive questions about who customarily pays for title insurance in the various counties throughout Florida.

Please feel free to use the county map below as a quick reference when preparing and negotiating contracts. As you’ll notice, in the majority of Florida counties, it is customary for the seller to pay for the owner’s title insurance policy.

It is important to remember that the selection in the contract regarding who pays for the title insurance premium is not based on Florida law, but rather on local custom and negotiation between the parties.

Under the Florida Realtors/Florida Bar contract, Paragraph 9(c)(i), (ii), or (iii) (including the Miami-Dade/Broward Regional Provision where applicable) determines which party designates the title company and pays the title insurance premium(s).
