DEALING WITH BAD LANDLORD ISSUES

Let's say you are on your way home from work. Immediately upon arriving at your premises, you discover that your premises has been locked by your landlord, because you've not paid your rentals for some time and the landlord won't unlock for you, not until you pay all that is due. How do you deal with such a situation as a tenant?

Well, you'd take the following course to sort out the situation.

The landlord owes a duty of care to the tenant under the law of tort, therefore, he must not create a situation where a tenant feels uncomfortable. Getting harassed is a serious offence which landlords should not take lightly, if a tenant has not violated any tenancy agreement terms and conditions.They are specific laws and protections created to protect tenants and punish violators. The main law that regulates residential leases in Zambia is the Rent Act Chapter 206 of the Laws of Zambia.

BELOW IS A LIST OF WHAT IS NOT ACCEPTABLE BEHAVIOR AND WHAT WOULD BE CONSIDERED HARASSMENT:

Entering an apartment without proper notice

Giving an eviction notice that is shorter than the stipulated time given by law

Taking away services provided in the tenancy agreement

Changing the locks while a tenant is away

WHAT TO DO IF YOU HAVE BEEN HARASSED BY YOUR LANDLORD

The Most efficient way to resolve the matter is to try and solve the issue directly with the owner in a civil manner. If you have tried to resolve a misunderstanding in a civil manner and still feel harassed by a landlord, you should seek legal advice on how to file an official complaint and possibly seek damages.

AS A HARASSED TENANT YOU SHOULD ALSO TAKE THE FOLLOWING STEPS TO PROTECT YOURSELF:

Keep a record of every encounter you have with your landlord. Make sure to take note of the time, date, and what was said.

Write a letter to your landlord asking for the harassment to stop.

Ask a witness to be there for any landlord interactions.

Keep copies of tenancy agreement, letter and notices.

You can engage the enforcement agents if you feel like you are in danger or your safety is threatened.

HOW TO DEAL WITH TENANT AND LANDLORD DISPUTES AND EVICTIONS

I would like to thank Chibanga Chitanda who made it possible for us to write this article, this followed when we posted an article "Finding the Ideal Tenant" she asked the following question from the same article which lead us to writing another article on the above topic. For the sake of reference purposes, her question was what steps can one take if a tenant refuse to move out from the property?

Well, the first thing you will have to know regarding tenant and landlord disputes and evictions matters is to have at least an overview of the laws governing the subject. We strongly encourage property owners to refer to these laws when drawing up the tenancy agreement, this will provide reference and strong evidence for any future disputes and litigation that may arise.
Therefore, it is wise to engage the services of an expert or simply download one from the internet and tailor it to meet your needs. For the purpose of the above subject matter, landlord and tenant act would be a good source to guide you through.

The following steps would be taken if the tenant refuse to move out:

Step 1: At any point given in time, you shouldn't take matters into your own hands to avoid violating any rights of your tenant.

Step 2: You must have a valid reason for the eviction and proof relating to the eviction decision.

Step 3: You must write an eviction letter that provides ample time notice of eviction

Step 4: File all your documentation with the courts. The court will be in charge to go through your filed documentation and grant eviction if it meets their requirements.

Step 5: If the tenant refuses to move out when the eviction has been served, you can now consider involving the law enforcement agents to assist with the eviction.

FINDING THE IDEAL TENANT

Well the economy isn't doing very well, as a result money is tight and you are looking for ways to cope up.

Step 2: Prepare all your documentation

Step 3: Research the market in order to find out how much your property can go for?

Step 4: Show your prospect tenants your property and carry out Know Your Client (KYC) procedures to have an idea who your prospect tenants are

Step 5: Once you have carried out KYC procedures you can now select the IDEAL TENANT to take up your property

Step 6: Now that you've the Ideal tenant you can wonderfully enjoy that consistently monthly extra income
